WWE Lawyer Jerry McDevitt Says The Company Plans To Request That The Class Action Lawsuit Filed Against Them Be Dismissed

Written by Richard Gray on Aug 28, 2008 - 7:31:59 PM

The Sun out of the United Kingdom interviewed WWE lawyer Jerry McDevitt about the class action lawsuit filed against the company by former WWE workers Scott Levy (Raven), Chris Klucsarits (Kanyon), and Mike Sanders. The three workers are seeking unspecified compensatory damages because they feel that while they were specified as "independent contractors" by WWE they were treated as full time employees.

McDevitt said that WWE plans to request that the lawsuit be dismissed by Federal Court.

McDevitt told the publication, "I think the key point to be made here is that every one of these people signed contracts acknowledging they were independent contractors... They contractually agreed that they would take care of their own health benefits and all the rest of that stuff... The IRS has never challenged the treatment of our wrestlers and they have audited the company several times."

McDevitt noted that it has been a long time since any of the wrestlers have worked in WWE and that Levy actually tried to pursue legal action against the company before. McDevitt also hinted that there was someone else behind the lawsuit and said he has an idea of who that it is.

Richard Reacts: I was not going to comment on this but I am having a hard time staying quiet. No one can force someone into signing a contract and if Raven, Kanyon, and Mike Sanders did not want to work as independent contractors they should have never signed contracts that stipulated that they would be treated as such. All three knew what they were getting into when they did it and probably even had representation read over the deal before they signed it. I know that the life of a professional wrestler is not easy but if you do not want to do it then don't do it. What's wrong with working a 9 to 5 job like everyone else? I believe in accountability and am strongly opposed to people that say that they were forced into something when they clearly were not. I am not going to feel sorry for someone that is doing a job that so many people can only dream to do. There are people right now doing everything they can just to get noticed by WWE or TNA. These guys had one heck of an opportunity and obviously have hidden agendas which make them bitter on the business. If you don't want to wrestle then don't wrestle.
